2. Collection and storage of personal data and the nature and purpose of their use

a) When visiting the website

When you access our website, the browser used on your end device automatically sends information to the server of our website. This information is temporarily stored in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer,
  • Date and time of access,
  • Name and URL of the retrieved file,
  • Website from which the access is made (referrer URL),
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

The above data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensuring a comfortable use of our website,
  • Evaluation of system security and stability, and
  • for other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 p. 1 lit. f DSGVO. Our legitimate interest follows from the purposes for data collection listed above. In no case do we use the collected data for the purpose of drawing conclusions about your person.

b) When registering for our newsletter

If you have expressly consented in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. To receive the newsletter, it is sufficient to provide an email address and this is done as follows:

When you register for the newsletter, we will send you an e-mail with a link to the address you have provided, which you must confirm. By doing so, we recognise that you are the owner and that you agree to receive the newsletter. No further data is collected. This data is only used for sending the newsletter and will not be passed on to third parties.

When you register for the newsletter, we store your IP address and the date of registration. This storage serves solely as proof in the event that a third party misuses an email address and registers to receive the newsletter without the knowledge of the authorised person.

The newsletter can be cancelled or revoked by the customer at any time free of charge. The cancellation can be made via a link in the newsletter itself or by sending a message to the contact options above.

c) When using our contact form

For questions of any kind, we offer you the possibility to contact us via a form provided on the website. In doing so, it is necessary to provide a valid e-mail address so that we know who the enquiry is from and so that we can answer it.

Further information can be provided voluntarily.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO on the basis of your voluntarily given consent.

The personal data collected by us for the use of the contact form will be automatically deleted after completion of your request.

3. Disclosure of data

Your personal data will not be transferred to third parties for purposes other than those listed below.

We will only share your personal information with third parties if:

  • you have given your express consent to this in accordance with Art. 6 para. 1 p. 1 lit. a DSGVO,
  • the disclosure is necessary in accordance with Art. 6 (1) p. 1 lit. f DSGVO for the assertion, exercise or defence of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that there is a legal obligation for the disclosure pursuant to Art. 6 para. 1 sentence 1 lit. c DSGVO, as well as
  • this is legally permissible and necessary according to Art. 6 para. 1 p. 1 lit. b DSGVO for the processing of contractual relationships with you.

4. Cookies

We use cookies on our site. These are small files that are automatically created by your browser and stored on your end device (laptop, tablet, smartphone or similar) when you visit our site. Cookies do not cause any damage to your end device and do not contain any viruses, Trojans or other malware.

Information is stored in the cookie that arises in connection with the specific end device used. However, this does not mean that we gain direct knowledge of your identity.

The use of cookies serves, on the one hand, to make the use of our offer more pleasant for you. We use so-called session cookies to recognise that you have already visited individual pages of our website. These are automatically deleted after you leave our site.

5. Analysis tools (tracking tools)

The tracking measures listed below and used by us are carried out on the basis of Art. 6 (1) sentence 1 lit. f DSGVO. With the tracking measures used, we want to ensure a needs-based design and the ongoing optimisation of our website. On the other hand, we use the tracking measures to statistically record the use of our website and to evaluate it for the purpose of optimising our offer for you. These interests are to be regarded as legitimate within the meaning of the aforementioned provision.

The respective data processing purposes and data categories can be found in the corresponding tracking tools.

a) Google Analytics

We use Google Analytics, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway, Mountain View, California, 94043 USA ("Google") on our websites. Google Analytics uses so-called "cookies" (see point 4.). The information generated by the cookie about the use of this website is usually transmitted to a Google server in the USA and stored there. In the event that IP anonymisation is activated on these web pages, however, Google will truncate the IP address beforehand within member states of the European Union or in other contracting states to the Agreement on the European Economic Area. We use the remarketing or "similar target groups" function of Google Inc. ("Google"). By means of this function, the provider can target the visitors of the website with advertisements by displaying personalised, interest-related advertisements to visitors of the provider's website when they visit other websites in the Google Display Network. To carry out the analysis of website usage, which forms the basis for the creation of the interest-based advertisements, Google uses so-called "cookies" (see under point 4.).

Cookies are used to record visits to the website and anonymised data on the use of the website. No personal data of the website visitors is stored. c) Google Adwords Conversion Tracking

In order to statistically record the use of our website and to evaluate it for the purpose of optimising our website for you, we also use Google Conversion Tracking. In this process, Google Adwords sets a so-called "cookie" (see section 4) on your computer if you have accessed our website via a Google ad. These cookies lose their validity after 30 days and are not used for personal identification. If the user visits certain pages of the Adwords client's website and the cookie has not yet expired, Google and the client can recognise that the user clicked on the ad and was redirected to this page.

Each Adwords customer receives a different cookie. Cookies can therefore not be tracked via the websites of Adwords customers. The information obtained using the conversion cookie is used to create conversion statistics for Adwords customers who have opted for conversion tracking. The Adwords customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that can be used to personally identify users.

On our websites, we use the so-called Facebook pixel of the social network Facebook, which is operated by Facebook Inc., 1 Hacker Way, Menlo Park, CA 94025, USA, or - if you are based in the EU - Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland.

The Facebook pixel is a JavaScript code that is integrated into our website for statistical and market research purposes. This enables Facebook to identify visitors to our online offer as a target group for the display of advertisements (so-called "Facebook ads").

The Facebook pixel is therefore used to display the Facebook ads placed by us only to those Facebook users who have also shown an interest in our online offer or who have certain characteristics (e.g. interests in certain topics or products determined on the basis of the websites visited) that we transmit to Facebook (so-called "Custom Audiences").

6. Social media plug-ins

We use social plug-ins of the following social networks on our website on the basis of Art. 6 (1) p. 1 lit. f DSGVO in order to make our website better known. The underlying promotional purpose is to be regarded as a legitimate interest within the meaning of the DSGVO. The responsibility for data protection-compliant operation is to be ensured by their respective providers. We integrate these plug-ins using the so-called two-click method in order to protect visitors to our website as best as possible.

a) Facebook

Elements of Facebook (so-called social media plugins) are integrated on our websites to make their use more personal. We use the "LIKE" or "SHARE" button for this purpose. Facebook is a company of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook").

By integrating the plugins, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information (including your IP address) is transmitted by your browser directly to a Facebook server in the USA and stored there.

If you are logged in to Facebook, Facebook can directly assign your visit to our website to your Facebook account. Each time one of our websites is called up that is provided with the "+1" element, customer data is transmitted to Google and stored by Google for a period of up to two weeks. This is the data already mentioned above under "Statistical data". If the customer clicks on the "+1" element while registered and logged in to Google Plus, this information will be transmitted to Google and stored there in relation to the customer's profile and made publicly available. c) Instagram

Our websites also use so-called social plugins ("plugins") from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram"). The Instagram plugin can be recognised by the "Instagram button", for example in the form of an "Instagram camera".

When you call up a page of our website that contains such a plugin, your browser establishes a direct connection to the Instagram servers. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. Through this integration, Instagram receives the information that your browser has called up the corresponding page of our website, even if you do not have an Instagram profile or are not currently logged in to Instagram.

This information (including your IP address) is transmitted by your browser directly to an Instagram server in the USA and stored there. If you are logged in to Instagram, Instagram can directly assign your visit to our website to your Instagram account. The provider of this content must perceive the IP address of the user here, as without the IP address it cannot send the content to the browser of the respective user. The IP address is used to be able to transport data from its sender to the intended recipient and is thus necessary for the display of this content. f) Audited webshop

The seal "Geprüfter Webshop" is integrated on our website. The seal and the services advertised with it are an offer of Tisko Consulting GmbH, Asbacher Straße 49, 53545 Linz am Rhein. When the seal is called up, the web server automatically saves a so-called server log file, which contains, for example, your IP address, the date and time of the call-up, the amount of data transferred and the requesting provider (access data) and documents the call-up. This access data is not evaluated and is automatically deleted at the latest 30 days after the end of your visit to the site.

Furthermore, you have the option of using the evaluation system of the tested webshop. After the conclusion of the contract, i.e. after receipt of your order, you can rate the transaction and comment on it if necessary.

In order to make you aware of this possibility, you will be contacted by us on the basis of Art. 6 para. 1 p. 1 lit. f DSGVO in the interest of a serious evaluation as part of the purchase transaction. The personal data collected by us for the purpose of using the rating system will be deleted 3 months after completion of the rated delivery of goods.

8. Creditworthiness information

In the case of the payment method "invoice", we call up creditworthiness information from specialised financial services companies (credit agencies) - address and creditworthiness data stored there about your person - for the purpose of credit checks and creditworthiness monitoring. This interest is to be regarded as legitimate within the meaning of the aforementioned provision.

The processing of the data stored by the respective information file is carried out for compelling reasons worthy of protection of creditors and credit protection, which regularly override your interests, rights and freedoms, or serves the assertion, exercise or defence of legal claims. You can only object to the processing of your data stored in the respective information file for reasons that arise from your special situation and must be proven. If such special reasons can be proven, the respective data will no longer be processed.

9. Data subject rights

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DSGVO. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, erasure, restriction of processing or objection, the existence of a right of complaint, the origin of your data if it has not been collected by us, as well as the existence of automated decision-making, including profiling, and, if applicable, meaningful information about its details;
  • demand the correction of incorrect or incomplete personal data stored by us without delay in accordance with Art. 16 DSGVO;
  • pursuant to Art. 17 DSGVO to request the erasure of your personal data stored by us, unless the processing is necessary for the exercise of the right to freedom of expression and information, for compliance with a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims;
  • to request the restriction of the processing of your personal data in accordance with Art. 18 DSGVO, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you object to its erasure and we no longer require the data, but you need it for the assertion, exercise or defence of legal claims or you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, common and machine-readable format or to request the transfer to another controller;
  • revoke your consent at any time in accordance with Art. 7 (3) DSGVO. This has the consequence that we may no longer continue the data processing based on this consent for the future; and
  •         complain to a supervisory authority in accordance with Art. 77 DSGVO if you are of the opinion that the processing of your personal data has been carried out unlawfully. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our registered office for this purpose.

10. Right of objection

If your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which is implemented by us without specifying a particular situation.

If you wish to exercise your right of revocation or objection, it is sufficient to send an e-mail to the e-mail address stated in the imprint.

11. Data security

We use the widespread SSL procedure (Secure Socket Layer) in connection with the highest encryption level supported by your browser when visiting the website. As a rule, this is 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. You can tell whether an individual page of our website is transmitted in encrypted form by the closed display of the key or lock symbol in the lower status bar of your browser.

We also use appropriate technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or against unauthorised access by third parties. Our security measures are continuously improved in line with technological developments.
